Rock giants The Foo Fighters have initiated legal action against Marvel Comics for copyright violation after claiming the company used their songs sans permission.
A lawsuit filed with the L.A. Superior Court states that "substantial excerpts" from their songs 'Best of You' and 'Free Me' were used on advertisements for the upcoming 'Wolverine and the X-Men' animated series. The lawsuit goes on to say that Marvel's song samples "were copied directly from the Foo Fighters' sound recordings of those two songs".
As is usually the case, the band are seeking unspecified damages, legal fees and an injunction preventing Marvel again from using the songs to promote their wares. Both songs were released on 2005's "In Your Honour" album.
